Mohave County Arrest Records

An arrest record is an official document by law enforcement that details the apprehension and detention of an individual for committing a crime. It includes details about an individual's arrest, such as personal information, charges or alleged offenses, the circumstances of the arrest, mug shots, etc.

When a person is arrested in Mohave County, they are typically booked in a holding facility. During booking, the individual's personal information, such as name, date of birth, address, and other identifying details, is collected. Furthermore, their fingerprints, photographs, and details of the arrest are recorded. All this information gathered during booking forms the arrest record.

The Mohave County Sheriff's Office generates and maintains arrest records for the county. Municipal police departments, like Kingman City Police, also create and manage records of arrests made within their jurisdictions. While local law enforcement agencies hold arrest records, they may also be found in certain public files, like Mohave County Court Records or criminal records from the Arizona Department of Public Safety (AzDPS).

This includes arrest records of minors, records related to ongoing investigations, arresting officer information, sensitive information like social security numbers and bank account numbers, etc., and personal identifying information of confidential informants or victims. Additionally, sealed or expunged arrest records are sequestered from public access.

To access exempt arrest records in Mohave County, written consent from the record subject or a court order authorizing disclosure is required. For non-exempt records, individuals should request them from the law enforcement agency responsible. Eligibility requirements, such as being the record subject or an authorized representative, may apply.

Mohave County Arrest Records Vs. Criminal Records

Arrest records and criminal records are related but distinct terms in Mohave County's criminal justice system. An arrest record documents specific instances when law enforcement, such as the Mohave County Sheriff's Office, apprehends an individual on suspicion of committing a crime. It includes details like the date and location of arrest, charges, arresting officer and arresting agency, mugshots, and descriptions of the circumstances surrounding an arrest. The arresting agency is the custodian of arrest records in Mohave County.

In contrast, a criminal record is a comprehensive file that details an individual's entire history with the criminal justice system in Arizona. This record includes all arrests, charges, court proceedings, convictions, sentences, and periods of incarceration. The Arizona Department of Public Safety (DPS) maintains criminal records for all state residents, including those in Mohave County.

How Long Do Arrests Stay on Your Record?

Permanently. Arrests remain on a person's record indefinitely in Mohave County. Per Arizona law, there is no specific time frame after which an arrest is automatically removed from a person's record. However, arrest records can be erased, removed, or concealed from disclosure through expungement or sealing under the Arizona Expungement Law.

Expunge Mohave County Arrest Records

Individuals with arrest records in Mohave County who meet the eligibility requirements can file a petition to seal or expunge their arrest records under Section 13-911 and Sec.36-2862 of the Arizona Revised Statutes. When an arrest record is sealed or expunged, the arrest history or instance is erased or removed from a person's record (or public access).

Per Arizona law, individuals can file a petition to expunge or seal their Mohave County arrest records related to an eligible criminal offense if the following requirements are met:

  • They were arrested and charged with the possession and consumption of marijuana (ARS § 36-2862).
  • The arrest record is related to a convicted crime where the terms and conditions of the sentence have been fully completed.
  • The arrests were for criminal charges that were dismissed or resulted in a not-guilty verdict.
  • The arrest incident is for a criminal offense for which no charges were ever filed.
  • The arrestee has not been convicted of any other offense except a misdemeanor traffic violation.
  • The following period has passed since the arrestee completed the conditions of probation or sentence: 10 years for a class 2 or 3 felonies, five years for a class 4, 5, or 6 felonies, three years for a class 1 misdemeanor, two years for a class 2 or 3 misdemeanors.

To seal or expunge arrest records, individuals who meet the above-listed eligibility requirement should file a petition to seal their arrest records to the court in Mohave County where their charges were filed or cases heard. Following the "Instructions to Complete Petition to Seal Criminal Case Records," they must complete and file the petition form at the appropriate courthouse.

The court may decide —after receiving the petition—whether to hold a hearing before ruling on the petition. Individuals who wish for a hearing to be held can request one. However, if the court deems the petition fails to meet statutory requirements or lacks sufficient information, it may dismiss the petition without a hearing.

If the court grants the petition under ARS § 13-911, the clerk is directed to seal case records related to the arrests. A copy of the order to seal is also transmitted to the arresting agency and the Arizona Department of Public Safety.

Note that if a petition to seal or expunge an arrest is granted in Mohave County, there are situations in which a person cannot deny that the arrest happened. For further information, see the "If the petition is granted" webpage of the Arizona Courts.
